TERMS & CONDITIONS

 

The website www.seashoreboats.com is a platform to accomplish online reservations for a boat charter. The user of the website who takes advantage of its services is below-mentioned as "client". The owner of the website is Seashore Boats SL, CIF B44631174 and below-mentioned as "company".

 

Duties of the company

The company is obligated to allocate the booked service to the client as confirmed. 

In case the booked service is not available as confirmed, the company has to inform the client and will offer to postpone the agreement. If the client does not agree with the change, the company will reimburse the total amount. The company will issue a confirmation, invoice and rental contract according to the booked service(s). 

 

Duties of the client

The client agrees to use the charter boat as if it were his property, according to the rules of the good navigator, and respecting the current legality. It will be the obligation of the client to keep the charter boat in good condition of use, as well as all the facilities in it. The client will not exceed the authorized number of people on board. The client undertakes not to govern the charter boat subject to this contract under the influence of any alcoholic beverages, toxic or narcotic drugs, or to embark arms or illegal substances.

In the event of an accident or breakdown, the client must contact the company by telephone as soon as possible. Always thinking about the safety of the people in charge and of the boat. In the case of an accident, an accident report must be made in writing, the causes, circumstances and consequences of what happened, as well as, if known, name, surnames and address of the party responsible for the event and the witnesses, as well as the names and addresses of the injured parties if any. If they are going to embark children, the client must inform the company in time to replace the life jackets for adults, for those suitable for the size of the children.

At the time fixed in the contract for the return of the vessel, the client must be leaving the charter boat and review the boat with an employee of the company.  If there are any damages or lost of equipment, the company will retain the amount of the paid deposit. The client undertakes not to participate with the boat in any regatta, nor in any sports competition. The charter boat must navigate within the limitations of the navigation area stated on the documentation on board.

 

Payment

The client is committed to pay the full amount of the charter fee by booking a service through the website. The client does not have any rights to use the boat if the balance is not fully paid. The company accepts payments with VISA, MASTERCARD, AMERICAN EXPRESS and PayPal.

 

Safety deposit

Before leaving the harbor, the client is committed to pay a deposit in cash or with credit card. The company will check the boat together with the client and any damages will be reported. The deposit will be used for damages the client caused during the rental time. The deposit will also be used for loss of equipment and it can be used as penalty, if the client does not return at the agreed time. The company will reimburse the deposit after return. Please note, if the deposit was paid with Credit Card the reimbursement can take up to 10 working days. 

Language for communication

For safety reasons, it is important to understand one of the following languages: English, Spanish, German. At the time of booking, the customer confirms to speak and understand at least one of the languages.The customer must be able to understand the safety briefing of our staff and be able to communicate with us in case of an emergency. A translation with Google Translate is not an option. The company reserves the right to cancel the excursion at short notice if it turns out that the client does not understand any of the languages listed above. In the event of a cancellation, the client will not receive a refund and the company does not cover any costs for transportation. 

 

Cancellation and refund

The cancellation and refund request must be realized by the client via mail to info@seashoreboats.com and will become effective on the date submitted. It will be subject to the following fees:

Cancellation prior 30 days of the date of booking

Refund of 100% of the paid amount

 

Cancellation between 30 and 15 days prior to the date of booking

Refund of 50% of the paid amount

 

Cancellation between 15 and 5 days prior to the date of booking

Refund of 25% of the paid amount

 

Cancellation between 5 until the day of the booking

No refund will be offered

 

Cancellation due to weather conditions

The company checks the weather conditions daily. If the weather conditions don’t ensure a safe navigation, the company will try to postpone the agreement. If this is not possible due to a lack of availability or other reason the company offers a refund of 100%. As the weather conditions can change quickly, the company doesn’t cover or refund costs for petrol or taxis in case of cancellation at short notice.

At the time of the online booking the client agrees to the cancellation policy and accepts the terms and conditions.
